A jury found Heath residentJason Nicholas Miller guilty of first degree murder on April 21 for the death of Brian Fisher on Nov. 19 2005.
Miller had entered a not guilty plea in the case but the jury in the 382nd Distric Court in Rockwall convicted him.
Miller was sentenced to 30 years in a Texas prison. He was indicted for the crime on Nov. 30, 2005.
Miller and a friend went to a Terrell bar on Nov. 18, according to testimony.
Miller pulled a 45-caliber handgun from a holster on his back while arguing with his friend, according to testimony.
Law enforcement were notified about the incident.
Miller then called some other friends who were playing cards at 10 Austin Cir. in Rockwall. Fsher, 23, was at the location and he and Miller’s friends refused to provide Miller with an alibi for the Terrell incident.
When Miller arrived at the Rockwall address he and Fisher got into an argument and Miller shot Fisher eight times. Fisher, also of Heath, died at the scene.
The other individuals detained Miller at the scene and notified law enforcement personnel of the shooting.
Miller’s attorneys claimed that Miller shot Fisher in self defense.
Fisher did not have a weapon on him during the incident.
